SPECIFICATIONS TO OBJECTIONS


 

              To the board of elections state of new york:

 

              WHEREAS, the undersigned, DORIS L. SASSOWER, a duly enrolled member of the Democratic Party, registered to vote for the office of Justice of the Supreme Court of the State of New York, Ninth Judicial District, being a duly qualified voter of the said Ninth Judicial District, which includes Westchester County, New York, did heretofore, on September 30, 2005, file with the Board of Elections of the State of New York Objections to the Nominating Certificate filed on September 29, 2005 in the office of the Board of Elections of the State of New York purporting to nominate WILLIAM A. KELLY, of New City, LEWIS LUBELL of Ardsley, JONATHAN LIPPMAN of Rye Brook, and JOSEPH S. ALESSANDRO of Thornwood, as the four (4) candidates of the Democratic Party for the office of Justice of the Supreme Court of the State of New York, Ninth Judicial District, to be voted upon at the General Election to be held on November 8th 2005;

              NOW, THEREFORE, the undersigned, pursuant to § 6-154 of the Election Law of the State of New York and other provisions of law applicable thereto, do hereby specify the following as grounds of her objections to said Certificate:

  • The Certificate of Nominations made by the Ninth Judicial District Convention of the Democratic Party executed by the Temporary Chairman, Reginald LaFayette is inaccurate, defective, invalid, illegal, null and void, and not in compliance with the requirements of law in that the transaction of business at the Convention was not conducted at the time and place therein described, with a duly elected Permanent Chairman and duly elected Permanent Secretary presiding, and the individuals purporting to have been nominated for the office of Justice of Supreme Court of the State of New York, Ninth Judicial District were not duly nominated as candidates for election to said public office.
  • The Delegates and Alternate Delegates who voted for candidates LIPPMAN, ALESSANDRO, KELLY, and LUBELL at said Convention participated therein and cast their votes for the election thereof, in accord and compliance with, and in furtherance of, the illegal contract entered into in 2005 in violation of §17-158 of the Election Law (“Corrupt Use of Position and Authority”) by REGINALD LAFAYETTE, Chair of the Westchester County Democratic Committee and ROSEMARIE PANIO, Chair of the Westchester County Republican Committee, as set forth in the Objections referred to on page 1 hereinabove. 
  • The Delegates and Alternate Delegates who attended, participated in, and voted at the Convention were selected by REGINALD LAFAYETTE to be elected to the position of Delegates and Alternate Delegates, after having procured promises, expressed or implied, from said Delegates and Alternate Delegates that, when attending the Convention, they would not form or exercise their independent opinions and judgments at said Convention, but, in fact, and, instead, that they would vote as Delegates and Alternate Delegates at said Convention in conformity with the instructions, wishes and desires of REGINALD LAFAYETTE AND ROSEMARIE PANIO to perform his agreed obligations under the aforesaid illegal 2005 contract entered into with said Panio.
  • The respective Certificates executed by LIPPMAN, ALESSANDRO, KELLY, and LUBELL, are inaccurate, defective, invalid, illegal, null and void in that the same purport to accept the “designation” of the Democratic Party as candidates for election at the General Election to be held on November 8, 2005, notwithstanding that New York’s Election Law requires such candidates to be “NOMINATED,” and not “DESIGNATED.”

For at least the foregoing reasons, said nominations are null and void, and the Nominating Certificates should be rejected by the New York State Board of Elections. 

The office of Justice of the Supreme Court of the State of New York, 9th Judicial District, is a judicial office, for which the electorate has a right of “election,” after a duly conducted judicial nominating convention.
