May 24, 2016: "Cuomo proposes 'a la carte' menu of 'LLC loophole' bills"
Politico (Bill Mahoney)

"Proposed executive budgets have repeatedly contained language to address LLCs, but that language has always fallen out by the time final budget language is agreed on. Last April, the BOE deadlocked over an opinion that would have changed its treatment of LLCs. A lawsuit attempting to force the board to change it was thrown out in March. Democrats in the Senate attempted to force a vote on the matter last year but were stymied by parliamentary regulations; a similar attempt this year seems fated for the same end. BOE enforcement counsel Risa Sugarman brought a case rooted on the original logic that some donations through LLCs circumvented contribution limits, but this was eventually settled out of court."

August 26, 2015 "Lawsuit could begin to close LLC loophole' for campaign donations"
Politico (Bill Mahoney)

"Sugarman's is not the only pending case in Albany over the LLC loophole. The Brennan Center for Justice and Emery Celli Brinckerhoff & Abady LLP similarly filed suit against the Board of Elections in Albany in July, saying the board had improperly interpreted election in determining that LLCs should be treated as individuals."
