"(a) Intervention as of right. Upon timely
motion, any person shall be permitted to intervene in any action:...
2. when the representation of the person's interest by the parties
is or may be inadequate and the person is or may be bound by the
judgment"

§1013: Intervention by permission:
Upon timely motion, any person may be permitted to
intervene in any action ... when the person's claim or
defense and the main action have a common question of law
or fact. In exercising its discretion, the court
shall consider whether the intervention will unduly delay the
determination of the action or prejudice the
substantial rights of any party.

"Voluntary discontinuance"
(b) "By
order of court. Except as provided by subdivision (a),
an action shall not be discontinued by a party asserting a claim
except upon order of the court and upon terms and conditions, as the court
deems proper..." (a) Without an order. Any
party asserting a claim may discontinue it without an order... 2.
by filing with the clerk of the court before the case has been submitted to
the court or jury a stipulation in writing signed by the attorneys of
