"Mr. Goldman, the criminal defense attorney, said he expects that Mr. Weisselberg and the Trump Organization will try to attack the prosecution itself as illegitimate, using a procedural defense known as a selective prosecution claim. Such a claim would argue that Democratic prosecutors were driven by political animus against the former Republican president and vindictively selected his company and a top employee for prosecution.
Mr. Goldman said the prosecution is unusual in several respects. Rarely has New York prosecuted the concealment of executive perks. The indictment also alleges Mr. Weisselberg concealed his status as a New York City resident in his tax filings. In New York, tax disputes over residency are common but don’t often become criminal matters.
But a lack of precedent doesn’t mean prosecutors acted in bad faith, Mr. Goldman said. He said judges almost always reject selective prosecution claims, which require overwhelming evidence of malicious motives and tend to involve claims of racial discrimination."
